TERMS AND CONDITIONS FOR THE WEB SHOP ”THE OATLET STORE” 

Effective from the 1st April 2015.

1. General

These terms and conditions for the web shop ”The Oatlet Store” contain the conditions on which Raisio Nutrition ltd supplies any products listed on the web shop to consumers. By using the web shop ”The Oatlet Store” the user agrees to be bound by these terms and conditions, Privacy Policy and Legal Notice.

Raisio Nutrition ltd reserves the right to change these terms and conditions at any time without prior notice. All orders are subject to the terms and conditions in force at the time of the order. Raisio Nutrition ltd is entitled to reject and terminate an order, if the customer has breached these terms and conditions or acted unlawfully.

The consumer legislation in force in Finland and the European Union shall be applied to the orders. All amendments to legislations shall enter into force as such, unless otherwise stipulated. Nothing in these terms and conditions shall affect or exclude the statutory rights of a consumer.

The web shop is open 24 hours throughout the year. Raisio Nutrition ltd reserves the right to remove the service or parts thereof temporarily out of use due to e.g. maintenance of the web site or equipment.

3. Customer

When making an order, the customer shall provide his/her contact information containing at least: name, address/delivery address (P.O. box is not accepted), telephone number and e-mail address.

The web shop does not sell products to retailers. Retailers should contact Raisio Nutrition ltd (see contact information above).

The web shop shall collect and maintain customer information as stated in Privacy Policy.

4. Products and prices

All prices are in euros and contain value added tax (excluding Norway and Switzerland), but not delivery costs. The sum payable for the order is defined by the prices in force at the time the order is made. Raisio Nutrition ltd reserves the right to change the prices.

Raisio Nutrition ltd reserves the right to restrict the sale of goods in exceptionally large batches.

Raisio Nutrition ltd does not guarantee that the products on the web shop are available. Only those products will be dispatched that are confirmed in a separate order confirmation.

Raisio Nutrition ltd reserves the right to cancel an order based on an apparent price error. An apparent price error means a possible pricing mistake so that the product’s price in the web shop is significantly and clearly not accurate.

5. Payment methods

Payment for the orders is made by online bank payment, a credit or a debit card or by PayPal.

In Finland companies, communities and state in can also pay orders with invoice in our online store.

Raisio Nutrition ltd will be shown as the seller in the account information and the credit card bill.

After payment, Raisio Nutrition ltd will send an order confirmation for the ordered products. It is not possible to change the order after payment. All reclamations are responsibility of Raisio Nutrition ltd.

The payment service is offered by Maksuturva Group Ltd (Company registration number 2121703-0) in co-operation with banks and credit institutions. You as a consumer are not required to register or pay extra costs for using the payment service. Maksuturva Group Ltd is an authorized payment institution supervised by the Financial Supervisory Authority (FIN-FSA). All data transfer and money transactions are SSL secured meaning that no external party can see your personal information. Maksuturva Group Ltd is the payment receiver.

Online bank payments

You can use the online payment services of any Finnish bank.

Card Payments (Visa, Visa Electron, MasterCard and Business Eurocard)

Card payments in our webstore are provided by Maksuturva Group Ltd in cooperation with Solinor Oy and Euroline AB. Maksuturva Group Ltd submits card payment transactions to Euroline AB, which has acquiring-agreements with the international card companies (Mastercard and Visa). Card numbers are not recorded in Maksuturva Group Ltd’s systems; the card data is processed by the technical service provider Solinor Oy. Solinor Oy has the highest “PCI DSS Level 1” security certification as per the PCI DSS –security standard developed by the international card companies. For its own activities, Maksuturva Group Ltd is certified to the PCI DSS –standard.

PayPal will be the seller when payments are made by PayPal Express Checkout. A contract will be formed between the customer and PayPal and PayPal shall be the recipient of the payment. Using PayPal as a payment service requires existing PayPal account or account can be created during the checkout. By using PayPal Express Checkout, you are accepting PayPal’s Terms and Privacy Policy. Raisio Nutrition ltd does not keep any card information in its systems.

Company invoice (only in Finland)

Companies, communities and the state can order products with invoice. We will check credit information of our customers with business ID before invoicing is activated. We will process and dispatch orders within 1 to 3 business days after we have received an order.

5 EUR invoicing fee will be added on company invoices.

Customers receiving invoice are expected to pay total sum of invoice within fourteen (14) days from invoicing date. If payment is delayed, 14 % p.a. interest on delayed payments and possible collection charges and legal costs are collected. All possible notifications about an invoice shall be made within seven (7) days from the date of the invoice.

6. Delivery and delivery time

Deliveries are made by PostNord Logistics or Posti to the delivery address given by the customer. When placing the order the customer will be able to choose the delivery method from the available options. Deliveries are made within the European Union as well as Norway and Switzerland. The customer is liable for the delivery information he/she has provided.

Delivery time depends on the availability of the products. The delivery time for the products that are in storage are given in the schedule below for each country. Delivery costs are paid at the same time as the payment of the order.

In Finland small deliveries can be delivered with Posti Pienlähetys and in other EU countries with Posti Priority Letter. In Finland deliveries can be made to Posti pick-up points or delivered to your home by Posti. In Finland (including Oland), in Sweden and in Denmark deliveries can be made to PostNord MyPack Collect pick up points. Notice about the delivery will be sent as text message to the number informed when making the order. All orders can be delivered as door-to-door delivery by PostNord DPD Classic to the address informed when making the order.

Delivery methods to Norway and Switzerland are Posti Priority Letter, Posti Priority Parcel and PostNord DPD Classic door-to-door deliveries. Delivery costs include cost of export clearance. The customer is liable for all possible costs of import clearance, customs duties and added value tax.

Delivery costs and delivery time estimates are stated in Shipping & Delivery for each country of destination.

7. Force majeure

Raisio Nutrition ltd is not liable for any damage caused by breach, error or delay in managing the orders or delivery that are attributable to causes beyond its control that it has not been able to foresee or avoid. A force majeure situation consist (including without limitation) governmental acts, war or threat of war, riot or civil commotion, personnel’s illness, problems with postal service, electrical or internet failure, electrics that are not attributable to Raisio Nutrition ltd, detainment caused by fire or other accident or strike, lock-out, boycott or embargo. Force Majeure or other aforementioned event entitles Raisio Nutrition ltd to halt deliveries for the duration of the event. In case the Force majeure lasts over three months, both Raisio Nutrition ltd and the customer are entitled to terminate the order without obligation to pay damages.

8. Right to return and withdrawal right (private consumers)

According to the Finnish Consumer Protection Act, the withdrawal right is not applicable to foodstuff (Consumer Protection Act, Chapter 6 Section 16.4). For other products the consumer has the right to withdraw from the contract of sale within 14 days from the receipt of the products, or in case the delivery consisted of several lots, the receipt of the last lot of products belonging to the same order. To meet the withdrawal deadline, it is sufficient to send the communication concerning the exercise of the right of withdrawal before the withdrawal period has expired. To exercise the right of withdrawal, the customer is required to contact Raisio Nutrition ltd’s customer care service and to return the withdrawal form or other unequivocal statement to: Raisio Nutrition ltd, The Oatlet Store, P.O. The customer shall return the products to Raisio Nutrition ltd no later than fourteen days from the day on which the customer has communicated his/her intention to withdraw from the contract. The products shall be returned to the address below:

If the customer withdraws from the contract, all received payments, including delivery costs (with the exception of the supplementary costs resulting from choosing a type of delivery other than the least expensive type of standard delivery offered) will be reimbursed without delay and in any case no later than fourteen days from the day on which Raisio Nutrition ltd has received the customer’s communication about withdrawal. Reimbursement shall be made using the same means of payment as used by the customer for the initial transaction, unless the customer has expressly agreed otherwise. There will not be any costs to the customer from the reimbursement of payments. The customer is liable for the immediate costs for returning the products. The costs for returning the products will not exceed 46 euros.

The customer is entitled to return the products only in the same condition as they were, when he/she received them. The customer is liable for any diminished value of the products resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the products.

9. Reclamations and returning a false or a faulty product

The customer shall check the condition of the delivery and the delivered products without delay and in any case within 7 days from receiving the delivery. Any reclamations for false or faulty products shall be made to Raisio Nutrition’s customer service within 14 days from receiving the product:

Raisio Nutrition ltd will pay for the return costs of the false or faulty product.

These terms and conditions are ultimately governed by, construed, and enforced in accordance with the laws of Finland excluding its choice of law principle. Any and all disputes arising from these terms and conditions or in connection with this Web site shall be exclusively submitted to and finally resolved by the competent courts of Finland, to the jurisdiction of which courts you are to submit. 

In case the parties cannot resolve the dispute concerning a sales contract through mutual negotiations, the consumer client is also entitled to take the matter to the Finnish Consumer Disputes Board (www.kuluttajariita.fi).

Before lodging the taking the matter to the Consumer Disputes Board, the consumer should be in contact with a local European Consumer Centre or in Finland the local Register Office’s Consumer Advisory Service (www.kuluttajaneuvonta.fi). Alternatively, a consumer may also use the European Commission online dispute resolution at the address  http://ec.europa.eu/consumers/odr/ .When filling the complaint, please enter our e-mail address customercare@oatletstore.com.
